1.0 Introduction
Télé-Ressources, as an employment agency, cares about respecting your privacy and about the protection of your personal information.

For the sake of transparency, we strive to be open about the personal information that we collect, how this data is used, to whom this data will be disclosed and the motives behind our information collection, usage, and disclosure.

In the context of the usage of our services, Télé-Ressources is susceptible to the gathering of personal information, and you are susceptible to the disclosure of this personal information. The collection, usage, communication and conservation of your personal information are all subject to the Act Respecting the Protection of Personal Information in the Private Sector (RLRQ, c. P-39.1) and, when applicable, to the General Data Protection Regulation (GDPR) of the European Union.

Télé-Ressources reserves the right to amend this policy at any time. Any modification will be published on our website. Usage of our services after the publishing of policy updates will be understood as an agreement with those updates.

The current Confidential and Personal Information Protection Privacy Policy is applicable to clients using our recruitment services, including employment applicants, candidates and temporary employees, subcontractors offering services, users of our website or candidates applying for a job offer with our company and within all Télé-Ressources activities across Canada.

The goal of the current policy is to expose our users to the following elements:

a) The way their data is collected and treated,
b) What are their rights according to this data,
c) Who is responsible for the collection and treatment of personal data,
d) To whom this data is disclosed, and
e) Télé-Ressources’s use of cookies on our website.

2.0 Personal Information
All factual or subjective information on an identifiable individual is considered personal information. Your personal information can include, without limitation, to first and surname, address, telephone number, social security number, gender, email address, birth date, etc.

Are not considered personal information an individual’s name and their professional contact information such as their position title, the address of their employment location, and professional phone number and email address.

Personal information must be protected regardless of the medium, such as written, virtual, audio, visual, computerized, etc.

The information anonymized according to applicable law and that cannot be retraced to an identifiable individual are not considered personal information.

3.0 Objectives of our Data Collection
During usage of our services, we collect your personal and confidential information only to the extent of maintaining candidate files during their employment search, to allow the placement of this candidate on an eventual employment position. In all cases, the communication of your personal and confidential information is subject to confidentiality upholding obligations and to the upholding of applicable laws and regulations.

The following examples of personal and confidential information could be collected, stored and used:

a) Names and surnames, addresses, birth dates, telephone numbers, email addresses, resumes, employer references, employment history, medical information, social insurance numbers, bank information.
b) Data on your perusal and usage of our websites, including referential source, duration of website usage, perused pages and website navigation paths.
c) Data entry on contact information updates as an employee.
d) Generated data on usage of our websites, including date, frequency and circumstances of the usage.
e) Information included in all communications by email with Télé-Ressources or by usage of our websites, including their content and metadata.
f) Any other personal information communicated to us.

4.0 Consent
Subject to exceptions and requirements according to applicable law, we will never communicate nor disclose your personal and confidential information with any third party without your consent.

Furthermore, by using one of our services, you consent to the collection, usage and communication of your personal and confidential information according to this policy.

Your agreement will be requested, depending on applicable cases:

  • By one of our recruiting agents for file updating and contractual purposes.
  • By a checking box on our Terms and Conditions form, online or on paper.

You can withdraw your consent at any moment, subject to legal or contractual restrictions.

Under certain circumstances, we can collect, use or disclose some personal information without consultation or express consent. Those circumstances apply when, for legal, medical, emergency or safety reasons, it is considered unlikely or impossible that we can obtain consent in time, or when information is required in the context of an investigation on a possible breach of contract, or to prevent or detect fraudulent activities, or to uphold the law.

Circumstances where your personal information could be shared without your consent are, when authorized by law:

  • Emergency situations or threats to one’s safety.
  • Compliance with a warrant or court order, or competent lawful authority.
  • Debt collection.
  • Investigation into an agreement violation or an applicable law.
  • To determine or verify eligibility to receive health care or goods, services, or related benefits.
  • To produce information in the context of an audit, a certification review or a certification query review.
  • To detect, prevent or stop fraudulent activities.
  • Within the context of a commercial transaction planned or realized, such as share transfer or merging, according to applicable legal requirements. We may make your personal information available to the advisors, buyers or potential buyers of our company if it is deemed necessary to reach the conclusion of the transaction and the pursuing of the company’s exploitation.

Before sharing the personal information of any person other than you with us, you must acquire their
consent according to the terms of this policy.

4.1 Personal Information Concerning a Minor
With the exception of information that employers are legally required to provide us concerning their employees, any personal information concerning a minor of less than 14 years old will not be collected without consent from a parental representative or legal guardian.

5.0 Limits to the Collection, Usage and Disclosure of Personal and Confidential Information
5.1 Collection
We limit the collection, usage and disclosure of personal and confidential information only to the aforementioned purposes within this policy. Your personal information can only be accessed by some authorized individuals, and only within the context of their attributed duties and functions.

We collect personal information in diverse ways, including through direct contact with you, through our websites and through third parties, generally from the general sources below:

a. Direct Contact
We can collect your personal information through direct contact with you, in cases such as:

  • When you submit resume information or use our services.
  • When you create an account and/or visit one of our websites, or when you contact us.
  • When you provide the information required by Télé-Ressources to complete your profile and to procure one of our services.

b. Third Parties
We can collect personal information on employment applicants, candidates, temporary employees, or subcontractors providing services, through third parties with your consent when this information is required by potential employers. We reserve the right to gather information on your educational history, verify employer references, and for criminal, credit or any other kinds of background checks on the account of our potential employer clients.

c. Websites
Télé-Ressources or our service providers, who help sustain our websites, can automatically collect the following information regarding your web access and usage of our websites through the use of cookies, authorization tokens, web markers or other related technologies: your domain name, navigator type, and exploitation system, your computer or mobile type, the pages perused, which links were clicked, IP address, website usage duration, and manner of website usage.

5.2 Usage
We may use the personal information we collect for the following purposes, or for other purposes, with your consent or as permitted or required by law.

a. Specifically, we may use your personal information for the following business purposes:

  • To provide our recruitment services and facilitate the recruitment process.
  • Validate that you meet the requirements of the positions you are looking for.
  • Follow up on your application process.
  • Confirm appointment booking and remind you of upcoming appointments.
  • Conduct investigations.
  • Comply with legal, regulatory and professional obligations.
  • Protection of our business interests, defense of our legal rights and interests and debt collection.
  • Creating, administering and maintaining your account.
  • Updating your personal information.
  • Payroll and payroll compliance.
  • Respond to your requests for information.
  • Improve our service offering.
  • Provide any other complementary services associated with the requested service.
  • Control the quality of customer service and prevent errors and fraud.
  • Fulfill our mandate as an employment agency.

b. Research and Development:
We may use personal information to understand and assess your interests and changing needs, in order to improve our services and develop new ones, as well as to evaluate potential improvements or other changes in the functionality of our websites. For example, we may use third-party web analytics services, such as Google Analytics, to help us analyze how visitors use our websites. Where required by law, we will use anonymized information for these purposes.

5.3 Disclosure of Your Personal Information with Other Organizations or Third Parties
Télé-Ressources may share your personal information with any of our employees, professional advisors, suppliers, or contractors or affiliates to the extent reasonably necessary to provide the requested services and for the purposes set forth in this policy.

Télé-Ressources may share certain categories of your personal information with third parties and disclose it to them in the following circumstances, or as permitted by applicable laws:

a. Potential Employers
Given the nature of our services, we may, with consent, share with our prospective employer clients personal information about job seekers, candidates and temporary employees, such as professional experience and qualifications, as well as references, credential and certification checks, and background checks (including criminal background checks) (e.g., criminal, credit and other similar types of information), where such information is requested from our prospective employer clients for potential and future assignments, for the purpose of assessing the application and suitability for the position. Job applicants, candidates and temporary employees who use our services understand that these employers will treat the personal information received in accordance with their own privacy policies and procedures.

b. Vendors, Consultants and Other Service Providers
We use vendors and other service providers to help us provide our services. In certain circumstances, it is necessary to provide access to your personal information to vendors for specific purposes, including payroll processing and compliance, government investigations, products and services for categories such as IT, background checks, candidate and employee training and testing, e-signature platform, employee rewards, etc. These third parties may only use personal information to the extent necessary to perform their functions and may only use it for the purpose of providing the services.

We generally do not disclose your personal information. From time to time, we may share your personal information with certain vendors or agents in order to provide the services you have requested from us. In all cases, we comply with the restrictions and requirements set out in the law when disclosing your personal information and all of this is subject to a written agreement and security assessment that demonstrates that your personal information is adequately protected.

Your personal information will not be disclosed to third parties other than in accordance with this Privacy Policy, except as required or permitted by law, or as ordered by a court of competent jurisdiction.

We may share the information collected with our service providers in order to provide the applicable services, including the purposes set out below.

We do not sell your personal information to third parties.

5.4 Impact Assessment
Impact assessments on the use of personal information are conducted before any personal information is used by Télé-Ressources. If transfers are made outside of Quebec, the impact on such a transfer will also be conducted.

5.5 International Data Transfers
The information we collect may be stored, processed, and transferred to all countries in which Télé- Ressources or its subcontractors offer their services, in order to enable us to use the information in accordance with this policy.

You expressly agree to the transfer of personal information described in this section.

6.0 Non-Personal Information
We automatically collect certain non-personal information using the third-party analytics program Google Analytics to help us understand how our visitors use our website, but none of this information can be used to identify you. Your IP address and other relevant information may be used to track fraudulent or criminal activity, or activities that violate the Terms of Use.

7.0 Cookies
Télé-Ressources’s web services use cookies. Cookies are small data files that are stored on the memory of your computer or mobile device when you visit a website or application for the purpose of enhancing your user experience by storing certain data on your computer or device. By using Télé- Ressources’s web services, you consent to this use.

7.1 Cookies Used on our Websites
a. Authentication
We use cookies to identify you when you visit and browse our website and portal. These cookies are used for connection and session management purposes.

b. Personalization
We use cookies to store information about your preferences and allow us to customize the service to your needs. The cookies used for these purposes are used to capture the language of use of our website.

7.2 Cookies Used by our Service Providers
Our service providers use cookies that may be stored on your computer or device when you visit our website.

7.3 Managing Cookies
Your browser or device can be set to refuse cookies or to delete them after they have been saved. Please consult the “Help” section of your browser or device for instructions. Please note that deleting or refusing these cookies may affect your user experience.

8.0 Accuracy
We make every effort to ensure that your personal information is accurate and complete for the purposes for which it was collected, used or disclosed.

9.0 Retention of Information
We retain your personal information for as long as necessary for the purposes for which it was collected. We must destroy or anonymize this information in accordance with the law and our records retention policy.

Your personal and confidential information is kept, directly or through subcontractors, only for as long as necessary for the purposes of the requested services and for the applicable legal and regulatory requirements. We require our subcontractors to adhere to confidentiality agreements and to apply policies equivalent to this one. In all cases, access to your personal and confidential information is limited to those persons for whom access is required while carrying out their duties.

10.0 Liability
We are responsible for personal information in our possession or custody, including information that we provide to third parties for the purpose of providing you with the requested service. We require these third parties to maintain this information according to strict standards of confidentiality and security.

We adhere to the principles set out by the law. We have policies and guidelines in place to protect your privacy. Our Privacy and Information Technology Security Officer oversees this Privacy Policy as well as the company’s various frameworks.

Our staff is informed and adequately trained on privacy policies and practices.

11.0 Safety Measures
We have implemented several security measures, with respect to the personal information and confidential data we hold, in order to protect it against loss, theft and to prevent unauthorized access, transmission, use or modification of this personal information, including by the following examples.

11.1 Privacy Impact Assessment
Télé-Ressources conducts a privacy impact assessment of any project involving the acquisition, development and redesign of an information system or electronic service delivery system involving the collection, use, disclosure, retention or destruction of personal information. This assessment documents the substantial and legitimate interest in the use of personal information.

11.2 Secure IT Environments
The infrastructure and equipment are hosted in a secure environment in a data center located in Quebec and Canada. If certain personal information is to be processed outside of Canada, the requirements set out in the “International Data Transfers” section will apply.

Access to Télé-Ressources’s Internet services is via a secure transmission channel with an SSL
certificate (HTTPS).

11.3 Access Management
Only employees whose duties require it have access to personal or confidential information. Data access is logged.

11.4 Training and Awareness
Our employees and partners are trained and made aware of the importance of protecting your personal information.

11.5 Confidentiality Commitment
The signing of a confidentiality agreement by our employees. Failure to comply with this commitment can result in sanctions up to and including dismissal.

Security audits are carried out by firms specializing in information security.

11.6 Destruction
We retain your personal information for as long as necessary for the purposes for which it was collected. We must destroy or anonymize this information in accordance with the law and our records retention policy. When we destroy or anonymize your personal information, we take steps to ensure its confidentiality.

We ensure that no unauthorized person can gain access to them during the destruction or anonymization process.

11.7 Management of Incidents Involving Personal Information
If Télé-Ressources has reason to believe that a confidentiality breach involving personal information has occurred, that it presents a risk of serious harm being caused, it will promptly inform the Commission d’accès à l’information (CAI) as well as any person whose personal information is affected by the incident. It may also notify any person or organization likely to reduce this risk, providing only the personal information necessary for that purpose without the consent of the individual to whom it relates. In all cases, a log will document the incident for reference.

12.0 Users’ Rights
12.1 Request for Access, Removal or Correction
You may, subject to any regulatory or contractual restrictions, access, have corrected or destroyed the personal information we have stored pertaining to you.

We will provide you with such information within a maximum of 30 days from the date of receipt of the written request and in a structured, commonly used technology format. However, a fee may be charged to process your application.

In certain special circumstances, we may refuse to provide you with the requested information. Exceptions to your right of access include the fact that the information cannot be disclosed for legal or security reasons. These limitations are outlined in the Act respecting the protection of personal information in the private sector.

You may verify the accuracy and completeness of your personal information and, if necessary, request that it be amended. Any request for modification will be dealt with within the framework of the law.

You may withdraw your consent to the collection, use and disclosure of your personal information at any time by providing us with reasonable written notice, subject to legal or business restrictions. Please be aware, however, that withdrawing your consent will affect our ability to provide you with our services that you receive and wish to receive, as the use and disclosure of your personal information is essential to making the service available to you.

12.2 Restriction and Objection of Data Processing
The user has the right to request the limitation or to object to the processing of their data by Télé- Ressources, and the latter may not refuse this request unless it can demonstrate the existence of legitimate or compelling legal grounds that may override the interests and rights and freedoms of the user.

13.0 Requests, Complaints and Questions

If our Privacy Officer decides not to respond to a request from a user and the user wishes to contest this decision, or, if they believe that one of their rights has been infringed on, they are entitled to contact the Commission d’accès à l’information du Québec (cai.gouv.qc.ca).

14.0 Review and Approval
This policy is effective immediately upon adoption by the Board of Directors and may be reviewed at any time by the Privacy Officer.

This policy should be reviewed at least every two years to ensure that it remains relevant to our mission, the activities of our users, and any material changes in legislation or regulatory requirements.

15.0 Effective Date
This policy takes effect on July 21, 2023. It cancels and replaces all the frameworks on this subject previously in force.
